Agreement and operator
MetaPresence is a product and trading name of FOUS VENTURES LLP (“FOUS,” “MetaPresence,” “we,” “us,” or “our”). These Terms of Service form a contract between FOUS VENTURES LLP and the person or organization using MetaPresence (“you”).
By creating an account, accepting an order, or using the service, you agree to these terms, our Privacy Policy, and our Acceptable Use Policy. If you use the service for an organization, you confirm that you have authority to bind it.
The service
MetaPresence provides software for creating and operating digital employees, personas, avatars, voice and video experiences, AI-assisted content, live conversations, connected knowledge, meetings, and workflow tools. Features and usage allowances depend on the plan shown at purchase.
Enterprise services, custom development, service levels, data-processing terms, or implementation work may be covered by a separate written order or agreement. If that document conflicts with these terms, the signed document controls for the conflict.
Accounts and eligibility
- You must be at least 18 years old and legally able to enter a contract.
- You must provide accurate account and billing information and keep it current.
- You are responsible for account activity, authorized users, credentials, and promptly reporting suspected unauthorized access.
- You may not share an account in a way that bypasses plan limits or sell access without our written permission.
Plans, billing, and Paddle
Plan price, billing interval, included usage, currency, and applicable taxes are shown before purchase. Subscriptions renew automatically for the same billing period until canceled. Usage above a plan allowance may be blocked, limited, or billed only where the applicable order clearly permits it.
Where Paddle Checkout or Paddle Invoicing is used, Paddle is the authorized reseller and merchant of record for the transaction. Paddle processes payment, calculates and remits applicable transaction taxes, issues transaction documents, and provides billing support. The transaction is subject to the Paddle Buyer Terms and Paddle Refund Policy. These MetaPresence terms remain the supplier agreement governing your use of the product.
You may cancel a Paddle subscription through the portal linked in Paddle’s transaction email or the Paddle customer portal. Cancellation normally takes effect at the end of the current paid period. Access continues until then unless the transaction terms, mandatory law, or a refund require otherwise. See our Refund Policy for details.
Your content and permissions
You retain ownership of content you submit and outputs you are legally entitled to own. You grant us a limited, non-exclusive, worldwide license to host, copy, transmit, modify, and process that content only as needed to provide, secure, support, and improve the service, comply with law, and enforce these terms.
You confirm that you have all rights, notices, and valid consents required for every image, voice, likeness, recording, document, dataset, instruction, and other material you submit. This includes informed permission from each identifiable person whose face, voice, likeness, or personal data is used.
We own MetaPresence, its software, designs, documentation, branding, and underlying technology. Your subscription grants a limited, revocable, non-transferable right to use the service during the applicable term. It does not transfer our intellectual property.
Responsible use
You must comply with applicable law, third-party rights, and our Acceptable Use Policy. You may not use MetaPresence for fraud, unlawful impersonation, deceptive deepfakes, harassment, exploitation, rights infringement, malicious automation, unlawful surveillance, or harmful content.
You are responsible for disclosures required when people interact with an AI system or synthetic media. You must not present an avatar, cloned voice, or generated statement as authentic human communication where doing so would mislead a reasonable person or breach applicable law.
AI outputs and decisions
AI-generated output may be incomplete, inaccurate, outdated, offensive, or unsuitable for a particular purpose. You must review output before publishing it or relying on it. The service does not provide legal, medical, financial, employment, or other regulated professional advice.
Do not use MetaPresence as the sole basis for decisions that create legal or similarly significant effects for a person, including decisions about employment, credit, insurance, housing, education, healthcare, or access to essential services. Appropriate qualified human review is required.
Availability and changes
We may update features, providers, limits, and technical requirements to maintain or improve the service. We may discontinue a material paid feature, but will provide reasonable notice where practicable. Third-party services, internet connections, meeting platforms, and AI providers may affect quality or availability.
We may update these terms for legal, security, operational, or product reasons. Material changes will be communicated through the service, website, or account email. Continued use after the stated effective date means you accept the revised terms, except where law requires express consent.
Suspension and termination
You may stop using the service at any time and may request account deletion. Subscription cancellation and refunds are handled separately under the billing section above.
We may limit or suspend access where reasonably necessary to address a security threat, unlawful activity, non-payment, material breach, harm to other users, or platform abuse. We will provide notice and a reasonable opportunity to remedy when appropriate. We may act without advance notice where delay would create legal, security, fraud, or safety risk.
Warranties and liability
The service is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, or consequential losses, or for lost profit, revenue, goodwill, or data. Our aggregate liability arising from the service will not exceed the fees paid for the affected service during the 12 months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, gross negligence where applicable, death or personal injury caused by negligence, or mandatory consumer rights.
Governing law
These terms are governed by the laws of Pakistan, without regard to conflict-of-law principles. Courts with jurisdiction in Lahore, Pakistan will have jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.
Paddle’s buyer terms separately govern your transaction with the applicable Paddle entity and specify the law and forum for that relationship.
